International patent rights

Technically, there is no such thing as an international or world-wide patent. To release your product or invention to the global market, you will need to file an application under the Patent Cooperation Treaty (PCT) of 1970. Filing a PCT patent application requires a single initial filing fee. However, it postpones the further expenses of the national patent process by around 30 months from your application date.  This allows you time to assess the value of your invention and determine the potential global market prior to investing in international patent protection.

Our attorneys can help your business file your patent under PCT at one of the international receiving offices. This then allows you to file future national patent applications in any of the states that have contracted under the treaty. Additionally, our legal team has experience helping overseas clients navigate U.S. patent law and prosecute patents in the USPTO. We also advise international clients on the patentability of foreign products in the U.S. market and whether those products infringe on any existing domestic patents.
